CARE COUNTSNew York

FAQ

Good questions, straight answers.

Doesn't New York already consider pets in divorce?

Yes. Domestic Relations Law §236(B)(5)(d)(15) requires considering a companion animal's best interest in matrimonial cases. A740 and S8927 / A11651 are pending proposals that would go further. None is enacted.

Which households would be covered?

The current matrimonial statute applies within matrimonial actions. Civil courts have also considered animal welfare outside marriage. A740 would expressly reach disputes involving an animal who lives or has lived with the parties, including unmarried households. S8927 / A11651 focus on divorce.

What questions should stronger language answer?

Who qualifies as a shared-household caregiver, and how is that different from pet-sitting or boarding? How can each party access relevant evidence? What short hearing timelines are workable for courts, with adequate notice and a fair chance to be heard? How can emergency protection be promptly reviewed, and safe arrangements avoid unsafe contact? These are drafting considerations behind our A740 recommendations, not claims about an organized opposition or reasons for committee delay.
